These Terms of Service (“Terms”) govern your access to and use of the website, products, and services of Agent Marketing Desk (“AMD,” “we,” “us,” or “our”). By using our website, placing an order, or engaging our services, you agree to these Terms. If you do not agree, please do not use our services.

1. Our services

AMD is a full-service marketing agency serving real estate agents, teams, and brokerages. Our services include branding and design, printed materials and signage, websites, photography and video production, social media management, direct mail and campaigns, AI tools and automation, and related products sold through our online store.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use our services. By using our services on behalf of a business or brokerage, you represent that you are authorized to bind that organization to these Terms.

3. Orders, products & payment

Products and services may be purchased through our online store or through a separate proposal or agreement. Prices, availability, and specifications may change at any time before an order is accepted. Payments are processed by our third-party payment and ecommerce providers; we do not store full payment card details. Many of our products are custom-made to your specifications — once production has begun, custom orders generally cannot be canceled, returned, or refunded except where required by law or stated in a specific agreement.

4. Recurring & subscription services

Certain services (such as social media management or marketing plans) are billed on a recurring basis and may include minimum terms described in your proposal or agreement. Recurring services continue until canceled in accordance with the applicable agreement.

5. Client responsibilities

To deliver our services, we rely on you to provide accurate information, brand assets, content, approvals, and any required licenses or memberships (for example, MLS or HAR access for listing tools) in a timely manner. You are responsible for the accuracy and legal right to use any materials you provide to us, and for ensuring your marketing complies with all applicable real estate, advertising, and fair housing laws and your brokerage’s policies.

6. Intellectual property

Unless otherwise agreed in writing, final deliverables we create for you (such as logos and custom designs) are licensed or assigned to you upon full payment for use in your real estate business. AMD retains ownership of its own underlying tools, templates, processes, and pre-existing materials, and may display non-confidential work in our portfolio. Content on this website is owned by AMD or its licensors and may not be copied or reused without permission.

7. Acceptable use

You agree not to misuse our website or services, including by attempting to disrupt the site, infringe others’ rights, upload unlawful content, or use our tools to generate deceptive or non-compliant marketing.

8. Third-party tools & links

Our website includes third-party tools, embeds, and links (such as form builders, chatbots, analytics, and social platforms). Your use of those tools may be subject to the third party’s own terms and privacy practices, and we are not responsible for their content or availability.

9. Disclaimers

Our services are provided “as is.” We work hard to deliver effective marketing, but we do not guarantee specific results, leads, sales, or rankings. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in a written agreement.

10. Limitation of liability

To the fullest extent permitted by law, AMD will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to a service will not exceed the amount you paid us for that service in the three months before the claim.

11. Indemnification

You agree to indemnify and hold AMD harmless from claims arising out of materials you provide, your use of our deliverables, or your violation of these Terms or applicable law.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any disputes will be handled in the state or federal courts located in Fort Bend County, Texas.

13. Changes

We may update these Terms from time to time. Changes are effective when posted, and your continued use of our services constitutes acceptance of the updated Terms.
